1. Acceptance of Terms

By downloading, installing, or using the Athion mobile application (the "App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Athion ("we," "our," or "us").

2. Description of Service

Athion is a fitness tracking application designed to help users plan and execute strength and conditioning routines. The App provides:

  • A curated library of over 1,500 exercises with video demonstrations
  • Routine and program creation tools
  • Workout tracking with set, rep, weight, and RPE logging
  • Progress insights, charts, PR tracking, and monthly reports
  • Rest timer with haptic feedback and Live Activity support
  • Apple Watch companion app for wrist-based workout tracking
  • Multi-language support (English, Spanish, German, French, Italian, Portuguese)
  • Optional cloud sync and data export (Premium)
  • Smart Progression for automatic weight/rep adjustments (Premium)

3. Health Disclaimer

Athion is not a medical application and does not provide medical advice. The App is designed as a fitness tracking and planning tool only. By using the App, you acknowledge and agree that:

  • You should consult a qualified physician or healthcare provider before beginning any exercise program, especially if you have pre-existing health conditions, injuries, or concerns.
  • The App does not diagnose, treat, cure, or prevent any disease or medical condition.
  • Smart Progression suggestions are algorithmic estimates and should be evaluated based on your own judgment and physical condition.
  • Estimated 1RM calculations and progression projections are approximations and should not be used as definitive training prescriptions.
  • You are solely responsible for your physical safety during exercise. You assume all risk of injury associated with your workouts.
  • The exercise videos and descriptions are for reference purposes; always prioritize proper form and your body's signals.

4. User Accounts

Athion operates with local, auth-less user profiles. You do not need to create an account to use the App. Your data is stored locally on your device. Premium users who enable CloudKit sync will have data associated with their Apple ID, which is managed by Apple and subject to Apple's terms of service.

5. Subscription Terms

5.1 Free Tier

The free version of Athion includes:

  • Up to 2 routines with up to 10 exercises each
  • Up to 5 custom exercises
  • Unlimited workout sessions
  • Workout history limited to the last 14 days
  • Basic insights (workouts per week, total sets, weekly volume)
  • Standard rest timer with manual duration
  • Local data storage only

5.2 Premium Subscription

Athion Premium unlocks additional features including:

  • Unlimited routines, exercises per routine, and custom exercises
  • Full workout history (no time restrictions)
  • Smart Progression (automatic weight/rep adjustments)
  • Advanced insights: PRs over time, estimated 1RM, volume by muscle group, streaks, monthly reports, and progression projections
  • Rest timer presets and auto-start logic
  • CloudKit sync across devices
  • Data export and import (JSON format)
  • Apple Watch companion app
  • Priority access to new features

5.3 Billing and Renewal

  • Premium subscriptions are available as monthly or yearly plans.
  • Payment is charged to your Apple ID account at confirmation of purchase.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • You can manage and cancel your subscription through the App Store subscription settings on your device.

5.4 Free Trials

We may offer free trial periods for Premium features. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription. Trial eligibility is determined by Apple and may be limited to one trial per Apple ID.

5.5 Refunds

All subscription payments are processed through Apple. Refund requests must be directed to Apple through their standard refund process. We do not have the ability to process refunds directly.

6. User Content

6.1 Your Content

You retain full ownership of all content you create within the App, including:

  • Custom exercises and their configurations
  • Routines and program templates
  • Workout logs and session data
  • Body measurements and personal records
  • Notes, tags, and preferences

6.2 Content Responsibility

You are solely responsible for any content you create within the App. We do not review, moderate, or endorse user-created exercises or routines.

7. Intellectual Property

  • The Athion name, logo, and branding are our intellectual property.
  • The built-in exercise library (+1,500 exercises), including names, descriptions, muscle-group mappings, equipment tags, and video demonstrations, is proprietary content.
  • App design, code, icons, animations, and user interface elements are protected by intellectual property laws.
  • Translated exercise content across all six supported languages is proprietary.
  • You may not copy, modify, distribute, sell, or reproduce any part of the App or its content without our written permission.

8. Acceptable Use

You agree not to:

  • Reverse engineer, decompile, or disassemble the App or any part of it.
  • Attempt to extract the exercise database, video content, or translations.
  • Use the App for any unlawful purpose or in violation of any applicable laws.
  • Interfere with or disrupt the App's services, servers, or infrastructure.
  • Attempt to circumvent subscription restrictions or feature gating.
  • Share your Premium subscription access with others.

9. Third-Party Services

The App integrates with third-party services that have their own terms:

  • Apple App Store — Your download and use of the App is also subject to Apple's Terms of Service and App Store policies.
  • Apple HealthKit — Health data integration is subject to Apple's HealthKit guidelines and privacy policies.
  • Apple CloudKit — Cloud sync is subject to Apple's iCloud terms of service.
  • RevenueCat — Subscription management services. RevenueCat Terms

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Athion is provided "as is" and "as available" without warranties of any kind, express or implied.
  • We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
  • We are not liable for any injuries, damages, or losses resulting from your use of the App or following any workout routines, exercise suggestions, or progression recommendations.
  • We are not responsible for data loss resulting from device failure, software issues, or cloud sync errors.
  • Our total liability shall not exceed the amount you paid for the App or Premium subscription in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Athion, its developers, and affiliates from and against any claims, damages, losses, liabilities, and expenses arising out of or in connection with your use of the App, your violation of these Terms, or your violation of any rights of another party.

12. Termination

  • You may stop using the App and delete it at any time.
  • We reserve the right to suspend or terminate access to the App if you violate these Terms.
  • Upon termination, your locally stored data remains on your device until the App is uninstalled.
  • Active subscriptions can only be cancelled through the App Store.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted within the App or on our website. We will notify you of material changes through an in-app notification or by updating the "Last updated" date. Your continued use of the App after any modification constitutes acceptance of the updated Terms.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Athion regarding your use of the App, superseding any prior agreements.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to conflict of law principles.
